DEAN BOARD ROOM OAK B R , K , BUTLER GOVERNMENT CENTER �� 1200 OAK BROOK ROAD OAK BROOK, ILLINOIS 630-368-5000 AGENDA ITEM Regular Board of Trustees Meeting of July 13, 2021 SUBJECT: Approval of an Agreement for Municipal Ordinance Violation and Municipal Offense System Hearing Software System including Internet-Based Payment Services FROM: Jim Fox, Information Technology Director BUDGET SOURCE/BUDGET IMPACT: Information Technology Program 151-72500 RECOMMENDED MOTION: I move that the Village Board authorize the Interim Village Manger to renew an agreement with Dacra Tech(Dacra) for Municipal Ordinance Violation and Municipal Offense System Hearing Software System including Internet-Based Payment Services pending, and approve 2021-PD-AG-DACRA-ADJUD- R-1953, a resolution approving the waiver of competitive bidding and authorizing the execution of the agreement for the purchase of vehicle parking and local code enforcement software and fine collection services for a 20-month term in the amount of$17,400. HISTORY: The administrative adjudication program and towing impoundment fee topics were brought to the Board of Trustees in November 2008. On January 26, 2010 the Board of Trustees entered in to an agreement with Municipal Systems, Inc. (MSI) now doing business as Dacra Tech(Dacra) to assist in the implementation of their administrative adjudication program/towing impoundment fee program. On June 12, 2012 the original software agreement with MSI/Dacra was expanded to include additional Municipal Ordinance Violation Modules along with Internet- Based Payment Services. The agreement was later amended on April 28, 2015. On April 1, 2021 the Village received notice from MSI/Dacra--that as part of the merger of the two companies --the Municipal Ordinance Violation Enforcement and Municipal Offense System agreement with the Village dated July 6, 2012 and amended on April 28, 2015, would be terminating on July 6, 2021. MSI/Dacra has offered the Village renewal options to continue the online software services for either a 20-month or 24-month term. Since Du-Page County is BOT AGENDA Page I investigating the purchase of a County-wide Ticketing Solution, the 20-month agreement is in the best interest of the Village. BACKGROUND: MSI/Dacra is a software development and consulting firm that assists government agencies in establishing local administrative adjudication processes for, Village Ordinance arrests and towing impound fees. MSI/Dacra provides a suite of solutions designed for government focusing on providing cost efficient solutions related to parking ticket enforcement, code enforcement, accounting and process management, while offering the highest level of customer service and support. The municipal solutions products are designed to issue, track, and adjudicate citations related to parking tickets, compliance, local ordinance and building code violations. From initial entry of a citation through to the final outcome, the MSI/Dacra software and services allows the Village to "take control" of the entire process. These solutions have allowed over 100 municipal customers to better manage associated costs, increase revenue, and gain greater control of compliance. It should be noted that the Village currently conducts Adjudication Hearings the second Wednesday of each month in the Dean Board Room. SURESH REDDY EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 13th day of July, 2021 RESOLUTION 2021-PD-AG-DACRA-ADJUD-R-1953 A RESOLUTION APPROVING AND AUTHORIZING AN AGREEMENT BY BETWEEN THE VILLAGE OF OAK BROOK AND DACRA TECH WHEREAS, the Village of Oak Brook ("Village") previously purchased online software from Municipal Systems, Inc. ("MSI") now doing business as Dacra Tech ("Dacra") to more efficiently administer the Village's adjudication of vehicle towing("Towing Software)with the use of the Towing Software has resulted in more efficient operations and savings for the Village; WHEREAS,the Village previously expanded the use of software to include enforcement of other local ordinance violations including,but not limited to,vehicle parking violations;and WHEREAS, the Village was notified by MSI/Dacra on April 1, 2021 that the original agreement was terminating on July 6,2021; WHEREAS,MSI/Dacra offered the Village options to renew the online services for either 20-months or 24-months; WHEREAS,the Village desires to continue the use of the software to continue with the administration of enforcement of other local ordinance violations and the Adjudication Process; WHEREAS,MSI/Dacra's software has met or exceeded the Village's expectations,there are only a few vendors that offer similar Adjudication Software products,and Village staff have reviewed the products offered by other vendors and believe that MSI/Dacra's Adjudication Software provides the best value to the Village at this time;and WHEREAS, the President and Board of Trustees, being fully advised in the premises, have determined that it is in the best interests of the Village and its residents to waive competitive bidding for the renewal of the Municipal Ordinance Violation and Municipal Offense System Hearing Software System including Internet-Based Payment Services Agreement. NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK,DU PAGE AND COOK COUNTIES,ILLINOIS as follows: Section One-Recitals The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this resolution are full,true and correct and do hereby,by reference, incorporate and make them part of this resolution as legislative findings. Section Two-Approval of Agreement The President and Board of Trustees hereby approve the Agreement attached hereto and made a part hereof as Exhibit A. Section Three-Authorization and Direction The Village President is hereby authorized to execute, and the Village Clerk is hereby authorized to attest the Agreement,substantially in the form of such agreement attached hereto as Exhibit A, with such changes therein as shall be approved by the Village Attorney and the officials of the Village executing the same,their execution thereof to constitute exclusive evidence of their approval to any and all changes or revisions therein from and after the execution and delivery of such Agreement. Section Four-Other Actions Authorized The officers, employees and/or agents of the Village shall take all actions necessary or reasonably required to carry out and give effect to the intent of this resolution and otherwise to consummate the transactions contemplated herein, and shall take all actions necessary in conformity therewith including, without limitation, the execution and delivery of all documents required to be delivered in connection with the transaction contemplated herein. Section Five-Authorization of Expenditures The Corporate Authorities hereby authorize and direct the expenditure of all costs related to the execution of the Agreement,additionally,the Village is authorized and directed to allocate and spend all necessary funds to fulfill the requirements of the Agreement and of this Resolution. Section Six-Waiver of Bidding Process To the extent that any requirement of bidding would be applicable to the transactions contemplated hereunder,the same is hereby waived. Section Seven-Acts of Village Officials That all past,present and future acts and doings of the officials of the Village that are in conformity with the purpose and intent of this resolution are hereby, in all respects, ratified, approved,authorized and confirmed. Section Eight-Effective Date This resolution shall be in full force and effect from and after its passage, approval and publication as provided by law. Section Nine-Publication This resolution shall be published in book or pamphlet form as provided by the Illinois Municipal Code. Section Ten-Conflict Clause All resolutions,parts of resolutions or board actions in conflict herewith are hereby repealed to the extent of such conflict. Section Eleven—Saving Clause If any section, paragraph,clause or provision of this resolution is declared by a court of law to be invalid or unconstitutional,the invalidity or unconstitutionality thereof shall not affect the validity of any other provisions of this resolution,which are hereby declared to be separable. Section Twelve—Recording This resolution shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Oak Brook.
