BUDGET SOURCE/BUDGET IMPACT: Approximately $760, to be paid through future
monthly employer contributions.
RECOMMENDED MOTION: I move the Village Board approve Resolution 2021-
IMRF-DIS-R-1955 "A Resolution Authorizing Disability Benefit Protection Leave".
Backeround/History:
During the COVID-19 pandemic,the Village took budgetary actions due to the uncertainty of
future revenues. One of those actions was furloughing part-time staff during the months of
April through June of 2020.
An employee has recently experienced a medical emergency and was denied short-term
disability benefits by the Illinois Municipal Retirement Fund (IMRF). The denial was due to
the service break this employee experienced during the furlough months, which caused them
to have less than 12 months of service time at the time of the medical emergency. The attached
Benefit Projection Leave resolution grants this employee the opportunity to buy-back three
months of approved unpaid leave. The total cost to the Village is estimated to be approximately
$760 and will be paid through future monthly employer contributions.
Recommendation
The Village Board approve Resolution 2021-IMRF-DIS-R-1955 "A Resolution Authorizing
Disability Benefit Protection Leave".

A RESOLUTION AUTHORIZING DISABILITY
BENEFIT PROTECTION LEAVE
WHEREAS, Article 7 of the Illinois Pension Code (40 ILCS 5/7-139(a)(4)) provides that the
governing body of a governmental unit may elect to allow service credit in the Illinois Municipal Retirement
Fund to members who are placed on authorized leave of absences without pay;and
WHEREAS,not more than twelve(12)complete months of creditable service for such authorized
leave of absence shall be credited towards any benefd under Article 7 of the Pension Code;and
WHEREAS, no service credit may be issued for such authorized, unpaid leave unless an
application for credits is submitted to the Board of Trustees of Illinois Municipal Retirement Fund while the
employee is in a status of active employment;and
NOW,THEREFORE,BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK,DU PAGE AND COOK COUNTIES,ILLINOIS as follows:
Section 1: The foregoing recitals are incorporated into,and made a part of,this Resolution as
the findings of the Village President and Board of Trustees.
Section 2: The President and Board of Trustees of the Village of Oak Brook elects to allow
service credit to Cathleen Chiarelli member ID 229-9144 for her period of authorized leave without pay,not
to exceed twelve months(12),beginning on April 1,2020 to July 1,2020.
Section 3: All associated costs thereof to the Village of Oak Brook as determined by the Fund
are hereby approved.
Section 4: The Village Clerk shall be directed to maintain a record of this resolution for
inspection, upon request by the Fund,and is further directed to certify IMRF Form 6.32, IMRF Benefit
Protection Leave,upon the request of the affected employee.
Section 5: This Resolution shall be in full force and effect upon passage and approval in the
manner provided by law.
