Kruger Jr., Interim Village Manager/Chief of Police BUDGET SOURCE/BUDGET IMPACT: Program 816- $See Schedule �/ RECOMMENDED MOTION: Move the Board approve Ordinance 2021-POLO-AG- PINE-S-1627, an ordinance approving and authorizing the execution of a long term lease agreement for the property commonly referred to as Cecil Smith Field #2, Oak Brook, Illinois 60523 with Pineoak Partners. Background/History: Pineoak Partners, LLC has been involved with discussions with Butler National Golf Club to bring Polo back to the Butler Range, They have reached an agreement for a Twelve (12) year period that would bring Ten (10) Sunday events each year from June through September. The attached summary shows how the Village would be made whole and not have to lose any revenue for the range lease we presently have with Butler National. As this involved the lease of Village property, this was published in the Daily Herald on August 20 and 25, 2021. The Village may terminate this agreement at any time with or without cause at its sole discretion upon 90 days written notice prior to the start of polo season,the start of the polo season shall be defined as the first scheduled game. Upon receipt of notice Pineoak may complete one full season immediately following the notice. Under the new rental agreement, Pineoak partners shall pay the Village $25,000 beginning in 2022 through 2026, $27,500 2027 through 2031 and $30,000 2032 and 2033. The Pineoak payment will be separate and apart from the Butler portion of the BOT AGENDA Page 1 leases, other than Butler National will receive a$20,000 annual credit as long as Pineoak occupies Field#2. Both organizations also agree to the following: • Butler National and OBPC will perform and allocate the cost of maintaining the Practice Property • Butler National will defend and indemnify the Village out of any suite alleged from the use of the Practice Property. • Butler National will remove the target greens but have the right to install temporary removable targets and posts removed for polo matches. • Butler National agrees to the use agreement with Pineoak Partners for ten dates annually in the season. • Butler National agrees to terminate any agreement with Pineoak should the agreement be terminated with the Village. Recommendation: The Village Board to consider and render a final decision and vote on the attached ordinance. BOT AGENDA page 2
