SURESH REDDY EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 9th day of August, 2022 RESOLUTION NO. 2022-BOT-PROTEM-R-2035 A RESOLUTION ELECTING AND APPOINTING A VILLAGE PRESIDENT PRO TEM WHEREAS, the Village of Oak Brook (hereinafter referred to as "Village") is a municipal corporation with authority provided for and granted pursuant to the Illinois Municipal Code to exercise certain powers and perform certain functions pertaining to its local government and affairs; WHEREAS, the Village has in full force and effect a codified set of ordinances which are of a general and permanent nature,which said codified set is known and designated as the Village Code of the Village of Oak Brook, as amended; WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs that protect the health, safety and welfare of its residents; WHEREAS, the Section 1-4A-4 of the Village Code of the Village of Oak Brook provides that the Village Board may elect one of their members to serve as the Village President Pro Tem; WHEREAS, the Village President Pro Tem shall perform the duties and possess all of the rights of the Village President in the event that the Village President is temporarily absent because of an incapacity to perform official duties, but the incapacity does not create a vacancy in the office; WHEREAS, the Village President and Board of Trustees believe that it is prudent to elect a President Pro Tem so that the Village has a President Pro Tem in place and ready to act in case the Village President becomes temporarily absent due to an unexpected incapacity; WHEREAS, the Village President and Board of Trustees have previously made said appointment for the purposes maintaining the continuity of government; WHEREAS, the Village of Oak Brook Corporate Authorities are of the opinion that it is in the best interests of the Village of Oak Brook to elect and appoint a Village President Pro Tem as set forth herein. NOW, THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows: Section One— Recitals The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this resolution are full, true and correct and do hereby, by reference, incorporate and make them part of this resolution as legislative findings. 2 Section Two — Election and Appointment of a President Pro Tem The Village Board of Trustees hereby elects and appoints Village Laurence Herman to serve as the Village's President Pro Tem until the occurrence of one of the following events: a. The Village Board of Trustees elects another Village Trustee to serve as the Village's President Pro Tem b. Trustee Laurence Herman's current term of office ends, C. Trustee Laurence Herman resigns or is removed from office, or d. the Legislative Session ends. Section Three- Repealer All prior resolutions and motions electing or appointing a Village President Pro Tem are hereby repealed and no longer of force and effect. Section Four—Effective Date This resolution shall be in full force and effect from and after its passage, approval and publication as provided by law. Section Five - Publication This resolution shall be published in book or pamphlet form as provided by the Illinois Municipal Code. Section Six—Conflict Clause All resolutions, parts of resolutions or board actions in conflict herewith are hereby repealed to the extent of such conflict. Section Seven — Saving Clause If any section, paragraph, clause or provision of this resolution is declared by a court of law to be invalid or unconstitutional, the invalidity or unconstitutionality thereof shall not affect the validity of any other provisions of this resolution, which are hereby declared to be separable. Section Eight—Recording This resolution shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Oak Brook.
