SURESH REDDY EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 26th day of April, 2022 OAK,BROOK,VILLAGE/General/DRAFT Ordinance Creating Business Registry/466930 ORDINANCE NO. 2022-LC-BR-G-1211 AN ORDINANCE ADOPTING A REGISTRY FOR ALL PERSONS WHO CONDUCT BUSINESS WITHIN THE VILLAGE OF OAK BROOK WHEREAS, the Village of Oak Brook (hereinafter referred to as the "Village") is an Illinois Municipal Corporation organized pursuant to the laws of the State of Illinois; WHEREAS, the Village has in full force and effect a codified set of ordinances which are of a general and permanent nature, which said codified set is known and designated as the Village Code of the Village of Oak Brook, as amended; WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs that protect the health, safety and welfare of its residents including the adoption and imposition of certain taxes; WHEREAS, through the Illinois Municipal Code, the Village is granted the authority to make all regulations which may be necessary or expedient for the promotion of health or the suppression of diseases (65 ILCS 5/11-20-5); WHEREAS, the Village therefore has a right to act to protect the health and safety of all Village residents and to regulate for the promotion of the public health and safety; WHEREAS, through the Illinois Municipal Code, the Village is granted the authority to adopt land use and zoning rules and regulations (65 ILCS 5/11-13-1); WHEREAS, the Village has a desire to plan for growth and future land uses in the Village, and to ensure properties are used in ways that are beneficial to the public health, safety and welfare; WHEREAS, the Village has established land use and zoning regulations for the purpose of establishing a plan for growth and ensuring neighboring properties are used in ways that are beneficial to the public health, safety and welfare; WHEREAS, the Village desires to monitor businesses' compliance with the Village's land use and zoning regulations; WHEREAS, through the Illinois Municipal Code, the Village is granted the authority to promulgate rules and regulations for the promotion of fire safety (65 ILCS 5/11-8-1 through 11-8-6); WHEREAS, through the Illinois Municipal Code, the Village is granted the authority to adopt rules and regulations related to construction, including, but not limited to, building codes and fire prevention codes (65 ILCS 5/1-3-2); WHEREAS, pursuant to the authority granted the Village to adopt building and fire codes, the Village has adopted numerous building codes (Village of Oak Brook Code of Ordinances, 10-1-1); OAK BROOK,VILLAGE/General/DRAFT Ordinance Creating Business Registry/466930 WHEREAS, pursuant to the authority granted the Village to adopt building and fire codes, the Village has adopted the International Fire Code (Village of Oak Brook Code of Ordinances, 10-2-1); WHEREAS, a business's failure to comply with the building and fire codes adopted by the Village could endanger the health and safety of Village residents; WHEREAS, pursuant to the duty to protect the health and safety of all Village residents, the Village desires to monitor businesses' compliance with the Village's building and fire codes; WHEREAS, in the interest of enforcing all rules and regulations the Village has the authority to adopt, the Illinois Municipal Code has vested the Village with the authority to adopt fees and penalties (65 ILCS 5/1-2-1); WHEREAS, the Corporate Authorities of the Village are of the opinion that an efficient and effective way to ensure businesses are complying with various rules and regulations is through monitoring what businesses are currently operating within the Village; WHEREAS, the Corporate Authorities of the Village are of the opinion that an efficient and effective way to monitor what businesses are currently operating within the Village would be to maintain a list of all said businesses; WHEREAS, the Corporate Authorities of the Village desire to adopt a business registry to aid in the compilation and maintenance of a list of all businesses currently operating within the Village; WHEREAS, the health and safety of the residents of the Village of Oak Brook would be further protected through the adoption of a business registry; WHEREAS, the Corporate Authorities of the Village of Oak Brook are of the opinion that that it is in the best interests of the safety, health and welfare of residents to adopt a business registry. NOW, THEREFORE, BE IT ORDAINED, in open meeting assembled by the Village President and Board of Trustees of the Village of Oak Brook, Cook and DuPage Counties, Illinois as follows: Section One - Recitals The Board of Trustees hereby find that all of the recitals hereinbefore stated as contained in the preamble to this ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this ordinance as legislative findings. Section Two —Adoption of a Business Registry A. Registration Required: Every person conducting business within the Village of Oak Brook (the "Village"), whether or not otherwise regulated or licensed by the OAK BROOK,VILLAGE/General/DRAFT Ordinance Creating Business Registry/466930 Village of Oak Brook or other governmental entities, shall be required to register annually with the Village. B. "Person" Defined: For the purposes of this chapter, a "person" is any individual person, charitable organization, firm, corporation, partnership or association which operates or maintains any type of business within the Village. C. Application: The application form can be obtained through the Village. The application form must be completed fully and accurately by the business owner or an authorized representative of the business. Any omissions or misrepresentations could delay registration and result in late penalties. D. Deadlines: The annual registration period shall run from January 1 through December 31 of the calendar year. Each business must renew its registration yearly before December 31. Each new business must register prior to commencing operations. E. Changes: It is the responsibility of the registrant to notify the Village of any changes to the information supplied during registration within a reasonable amount of time. F. Penalties: Failure to comply with the provisions of this chapter shall subject the violator to penalties and late fees. A Business will incur a $25.00 late fee for its first failure to comply with the provisions of this chapter, and said fee will be raised to $50.00 for every offense thereafter. Section Three— Effective Date That this ordinance become effective immediately after its passage. Section Four- Conflict Clause That all ordinances, parts of ordinances or board actions in conflict with the terms of this ordinance shall be repealed to the extent of said conflict. Section Five - Passage Clause That this ordinance shall take full force and effect from and after its passage, approval and publication as provided by law. Section Six - Constitutionality Clause Any part or parts of this ordinance declared by a court of law to be invalid or unconstitutional shall not affect the validity of the remaining provisions of this ordinance or the Oak Brook Municipal Code. Section Eight- Publication This ordinance shall be published in book or pamphlet form as provided by the Illinois Municipal Code. Section Nine- Recording This ordinance shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Oak Brook.
