RESOLUTION NO. R-256
A RESOLUTION ACCEPTING CERTAIN MANAGEMENT
RESPONSIBILITIES AS A DESIGNATED MANAGEMENT AGENCY
UNDER THE WATER QUALITY MANAGEMENT PLAN FOR NORTHEASTERN ILLINOIS
WHEREAS, the Northeastern Illinois Planning Commis-
sion has prepared and adopted a water quality management plan for
northeastern Illinois under the provisions of Section 208 of Pub-
lic Law 92-500; and
WHEREAS, the plan, upon its certification by the
Governor and acceptance by USEPA, will be the official plan for
northeastern Illinois and will be applicable to the jurisdiction
of the Village of Oak Brook; and
WHEREAS, the plan proposes that the Village of Oak
Brook be designated as a management agency responsible for imple-
menting portions of the plan and for cooperating and coordinating
with other designated management agencies; and
WHEREAS, the Village of Oak Brook has examined the
proposed responsibilities as set forth herein; and
WHEREAS, the Village of Oak Brook has examined and
modified the proposed management responsibilities as set forth in
the Statement of Management Responsibilities prepared by the North-
eastern Illinois Planning Commission; and
WHEREAS, the management responsibilities are not de-
tailed actions but rather are desired goals and events which may
aid in the enhancement of water quality in the Northeastern Illinois
region; and
WHEREAS, the Village of Oak Brook will work with the
Northeastern Illinois Planning Commission and the local County-wide
208 Committee in further refining the responsibilities and programs
through the continuing planning process;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK
COUNTIES, ILLINOIS, that it accepts certain management responsi-
bilities and its designation as a management agency under the water
quality management plan for northeastern Illinois, as follows:
I. RESPONSIBILITIES FOR CONTROL OF POINT SOURCES
A. Water Conservation
In order to reduce wastewater flows, the
Village has modified its building/plumbing
code to require installation of water con-
serving plumbing fixtures, to require me-
tering of all new development, and to set
seater rates consistent with the goal of
reducing wastewater flow and discouraging
high volume water usage. The Village agrees
to consider a water conservation education
program subject to its financial resources
and abilities.

B. Phosphate Detergent Ban
The Village agrees to consider by July 1,
1980 an ordinance banning the sale of high
phosphate detergents for domestic use with-
in the Village boundaries.
II. RESPONSIBILITIES FOR CONTROL OF NON-POINT SOURCES
A. Reduction In Pollutants From Stormwater Run-off.
(1) The Village has enacted stormwater detention re-
quirements as part of its development regulations
so as to limit runoff from newly urbanized areas
to its pre-urbanization levels. The Village
agrees to cooperate with the local area water
quality committee (referred to in item III below)
in achieving consistency between local ordinances
and determining the minimum standards necessary
to achieve pre-urbanization runoff levels.
(2) The Village agrees to consider enactment of soil
erosion and sedimentation control regulations to
control runoff and sedimentation from construc-
tion activities. The Village agrees to cooperate
with the local area water quality committee in
assuring consistency between ordinances.
(3) The Village agrees to work with other designated
208 management agencies in a cooperative effort
through the local area water quality committee
to develop plans and standards for the implemen-
tation of practices which may include: street
cleaning and catch ba.;in cleaning programs, per-
formance zoning, use of pervious pavement sur-
faces, increased vegetation cover, grassed water-
ways, wetland storage of stormwater, stormwater
detention, sedimentation and erosion control, and
other appropriate measures to achieve the target
pollutant reductions.

(1) The Village agrees to consider adoption of mea-
sures to control surface runoff from open stor-
age yards for industrial and construction mate-
rials.
(2) The Village agrees to develop or participate in
programs to control the application of de-icing
materials, to train personnel in proper appli-
cation methods, and to use proper equipment in
order to minimize any negative water quality
impacts.
III. RESPONSIBILITY TO PARTICIPATE IN LOCAL WATER QUALITY
COMMITTEE
The Village will participate in the organization and
operation of the local area water quality committee
and assist the committee in fulfilling its responsi -
bilities, including the preparation of an annual im-
plementation program, the coordination of local water
quality ita 'program.

1/ BE IT FURTHER RESOLVED that this acceptance of manage-
ment responsibility concepts is not an acceptance of the more de-
tailed studies, programs and/or actions which must be developed to
implement the goals and objectives of the 208 plan. As these more
detailed studies are prepared the Village will review and comment
on each study and will also determine on a case by case basis wheth-
er or not to accept the findings and recommendations of the studies;
provided that the Village of Oak Brook will seek to achieve the basin-
wide goals for pollution reduction in those streams which drain the
Village as much as possible, but because of the general lack of sup-
portive data on non-point control alternatives, the Village can not
assure NIPC or the IEPA that it will or is physically or financially
capable of achieving the basin-wide goals.
BE IT FURTHER RESOLVED that this acceptance shall be
subject to withdrawal or modification if the Village of Oak Brook
finds that through the continuing planning program that the general
concepts of responsibilities referred to in this Resolution are no
longer technically, financially or politically feasible, of if amend-
ments to the 208 plan make such management agreements no longer nec-
essary. This management acceptance statement shall remain in force
unless and until withdrawn or modified by the Village of Oak Brook.
