Ft Ar • RESOLUTION R- 295 A RESOLUTION APPROVING THE FINAL PLAT OF TWAROG'S RESUBDIVISION WHEREAS, the Plan Commission of the Village of Oak Brook on December 15, 1980 recommended approval of the Final Plat of the proposed subdivision known as Twarog's Resubdivision; and WHEREAS, the President -and Board'of° Trustees of the Village of Oak Brook have heretofore granted a variation from the lot width provisions under the R-2 Single-Family Detached Re- ,� sidence District zoning regulations to allow the proposed L©t `I� to consist of a lot width of approximately 108 fe4et measured eat the front lot line; and WHEREAS, the President and Board;of Trustees of the Village of Oak Brook have considered the rein ?predation of the Plan Commission and concur with the same; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section l: That the final plat of the subdivision known as "Twarog's Resubdivision" as prepared by Ronald W. Scott as revised and dated (as received) January 9, 1981 be and is hereby _ approved subject to the conditions enumerated in Section 2 of this Resolution. Section 2: That the approval of the Final Plat of Subdivision of said Twarog's Resubdivision as given in Section 1 hereof be and is hereby expressly subject to the following con- ditions: A. That the requirements of the Subdivision Re- gulations for street lights and sidewalks are . waived. B. That all of the other requirements, .conditions, and standards of the Subdivision Regulations of the Village of Oak Brook shall be applicable to said subdivision except that no additional public improvements shall be required. Section 3: That all resolutions, rules and regulations of the Village of Oak Brook in conflict with the provisions of this Resolution are hereby repealed to the extent of such conflict. As you n�o doubt know, the subject of a varianee to allow Twarog to divicNe his property for resale was reviewed by the Zoning Board or� 0ctober 7, 1980 (and two prior meetings) . At two of these me:etings there was an insufficient number of votes for a t clear-cut decision,._ On Qctober ] Mr. Crouch, a new member, had � to abstain, three members voted against the variance, and one in favor. My property is adjacent and south �of Mr. Twarog's and I oppose his dividing the property for the building of another home. His property is a very irregular shape and does not lend itself to reasonable subdivision into two properties in keeping with the catiber of homes and property in Oak Brook. His property, like mine and two neighbors, is served by a private road (Oak Brook Drive} and woutd be undesErable to increase the density of traffic on this road because of its size and lack of public maintenance. Acting Chairman Hodges noted that Member Crouch will not vate as anew member since this is acontinuation of a hearing originally camatenced at the September Zoning Board of Appeals Meeting. There fallowed a discussion of the need for Member Crouch to read the trans- �xipt in order to vote, whieh transcript is not normally pregared. l�x�. Zajicek then updated and reviewed his grior presentation of 9/2/80 snd noted that at the previous Zoning Board of Appeals hearing numerous ' fasues were brought up characzerized by Mr. Zajicek as P1an Go�.ission . issues, He noted that it is up ta the Plan Commission to define the . front yard .and that the petitioner proposes the creation of an interior ].at and not a flag lot by virtue of the proposed subdivision. He noted � that the proposed subdivision would have a 20 foot minimum access pro- vision which satisfies the Subdivision Regulations. Iie further noted that the theory and intent of the Subdivision Ordinance is to allow interior lots, provided there is permanent access. Member Hodges noted that the width of the Southerly proposed lot and not the minimum access provision for the interior lot is the question before the Zoning Board of Appeals. - Mr• Zajicek e�cplained that a flag lot access area is not counted for the aii�nimum lot area and notes that the proposed Southerly Iot,. subtracting the access area, meets the lot requirements of the R-2 District. In answer to a question from Acting Chairman Hodges, Pir. Zajicek noted that the proposed lot 1 is an interior lot. Further questions from Acting Chairman Hodges concerning the lot area for lot 1 was answered by Mr. Zajcek with � an explanation that the petitioner could seek a Plan Commission variance frbm the 20 foot requirement for the access area. He further explained the discrepency in the Zoning Ordinance provisions under the R-2 District for �asuring lot width within the buildable area and the Zoning Ordinance de:Einition of "lot width". Finally he noted that the loan objector that � spake at the September hearing would not be here but for a prior variation granted by the Village in regards to the lot which that person now o��ns. In answer to a q'uestion by Actin� Chairman Hodges, Mr. Zajicek noted that that location of the proposed residence is only tentative based upon engineering recommendations and that no potential purchaser is presently knawn. Mr� Zajicek answered Member Savino's question that the hardship in question is that one family is forced to support two acres of property when the Zo�iing Ordinance requires only one acre area. In answer to a question by Member Crouch, "Mr. Zajicek explained the dimensions of the original Rossman property as totalling over six acres. Member McCormick quzstioned the potential development of the vacant area- to the North and the nature of that development. Mr. Zajicek noted that he had no idea of how .or when that property will be developed. Mr. Zajicek noted that he desired Plan Commission issues regarding the access area in question and other Plan Commission issues to be left to the Plan Commission and only desired an answer to the variation question. He noted : that a total of 62 feet in variations was granted to the properties to the South and that his client is only asking for a 42 foot variation fox similar sized property. , No one else spoke in favor of or opgosed to the application in question. In answer to a specific question from Acting Chairman Hodges, Mr. Zajicek noted that he would desire Member Crouch to vote, but that he desired to vote tonight as opposed to waiting another month for a transcript to be prepared and reviewed by Member Crouch and the other absent members. � There being no further discussion, a motion was made by Member McCormick, seconded by Member Savino that the the Zoning Board of Appeals recommend denial of the variation since 1) Lot 1 was too small in width; 2) no hardship had been shown; and 3) there is no showing that the property cannot be reasonably developed as zoned. TWAROG - LOT SIZE VARIATION . � . . � Mro D�vid Zajicek, attorney for the owner, described the propertq in question � ss app�ro?timately 2.097 acres West of Oak Brook Drive and North of Oak Brook Road (;31st Street). He noted that the petitioner seeks a variation from the � R-2 lat width provisions to allow the subdivision of a lot into two (2) lots, one (1.) lot which would have a frontage of 108 feet and rear lot line of � 94 fee,t in width. Exhibit ��6 - A copy of the Plat of Rickert's Subdivision • Mr: Trwarog then testified that he purchased the property in 1971 from Zir. and . Mrs. R�ssman. He further testified that the Rossman's wanted to sell all of the�.r �6.5 acres to Twarog but he wanted to buy only one acre. He noted that � they w�uld not sell less than two acres which. is the pr�sent property ��hich is the sutiject of the present petition. , The ne:xt witness for the petitioner was Mr. Larry Fillippi, a land planner, who e�lained his analysis of the property as well as the characteristics of the proper�ty. He noted that there is a buffer of pine trees along the South prop- erty l:ine of the property in question which pravides effective screening for that lc�t. He further noted that the site is unique due to the large un- buildahle area to the West which enhances the open space concept. Although , he noted that•.the lot size is important, this size is unique and that lot width is not important here since the proposed house on the proposed lot �1 would be approximately 65 feet from the house to the South well in excess of the required 18 foot side yards for each structure in question. Mr. Fillippi further. noted that the site is slightly rolling and the proposed house site • is set on the highest point in order to preserve the view on the lot and also to fur�her preserve the trees on the site. tie further offered his opi.nion that the variation if granted would not cause any re�iuction in value to the surrounding property and would have no adverse . effect on the surrounding property. . Mr. Zaj�ice�c further noted that soil tests have been made and perculation tests conduct:ed on the site which showed that the soils are appropriate for the , propos�d construction as well as to construct a septic system for the property. He then offered into evidence� the aforementioned Exhibits �l thru ��6 as well Exhibit: �7, an engineering report, regarding the soils and Exhibit ��8, per- culati�n test relative to acceptability of the property foz a septic system. He further described the proposed creation of a common access easement for the two properties in question and noted that there would be another easement for the mutual benefit of both properties over the West 8 feet of the property. $e explained that the question of lot width as to the proposed lot ��1 is less important because of the immunities featured on the site. He suggested that _ as a condition of the variation if granted, it would be appropriate to require � a more extensive rear yard set back than the Zoning Ordinance requirement of 60 feet, and would agree to such a condition. He noted that in his opinion � �the property as presently zoned is under developed in allowing only one house on a two plus acre site. Mr. Zajicek then offered into evidence Exhibits �9 through �13, being letters from surrounding property owners stating no objection to the proposed varia- . . tion. He further explained that variations have previ.ously been granted to � the two lots to the South pursuant to Ordinance S-125 which was offered into evidence as Exhibit �14. � . ` . In response to a question by Memher Hodges, Mr. Zajicek noted that the pro�osed lot �l would be less than one acre if Oak Brook Drive were dedicated as a public street. He e�lained that Oak Brook Drive is a private street and see„s this situation as comparable to the lot to the South. He further noted that he does not see the common drive as a problem. . ' Member Hodges noted that he sees the undersized lot being taxed to the limit by the comEnon access drive easement whereupon Mr. Zajicek noted that he sees the hardship justifying the variation as having the owner maintain the two acre lot where the Ordinance requires only one acre under the R-2 zoning. In response to a question by Member Muschler, Mr. Zajicek noted that the 94 . _ foot rear lot line width is necessary in order to keep proposed lot �2 as one acre. In response to a question by Member McCarmick, Mr. Zajicek noted that the two lots to the South were granted their variation pursuant to Ordinance S-125 in 1967 and that apparently no plat of subdivision of these two resultant lots . were ever recorded. Member McCormick noted that the plat shows no proposed easements for the proposed lot 4�2 and questioned the possihility of a dedica- tion of the street in question. Mr. Zajicek noted that he sees no possibility � for .the driveway easement over to the proposed lot �2. 1Kember McCormick further noted that the situation �involved presently does not even have a flag lot and that there is no front lot line for proposed lot �2 since it does not abut a street. Member Hodges noted that he does not see the private drive as a street and cited the Subdivision Ordinance in support of that position. Ta�orog Lot Size Variation - 2800 Oak Brook Drive Dear President and Trustees: The Zon�:ng Board of Appeals at its regular meetings of September 2, 1980 and October 7, 1980 considered the request of Mr. Twarog for a variation from the Zoning Ordinance provisions for the R-2 zoning classification regarding lot width. The requested variation was to a11ow the subdivision of an existing , , 2.097 acre lot into two parcels, the Southerly lot of which is proposed to have a lot w�:dth of 108 feet where the Zoning Ordinance requires a minimum lot width of 150 f:eet. A motion was made by Member McCormick, seconded by Member Savino that the Zoning Board of Appeals recommend denial of the variation requested for three reasons: 1, That proposed Lot 1 is too small in width; 2. No hardship had been shown.; and 3. Petitionar r�ade no showing t.hat the property cannot be reasonably developed as zoned. TWAROG - LOT SIZE VARIATION Attorney David Zajicek, attorney for the petitioner, presented testimony on his behalf. Acting Chairman Hodges noted that Member Crouch will not vote as anew member since thisis acontinuation of a hearing originally commenced at the September Zoning Board of Appeals Meeting. There followed a discussion of the need for Member Crouch to read the trans- cri�t in order to vote, which transcript is not normally prepared. Mr. Zajicek then updated and reviewed his prior presentation of 9/2/80 a:nd noted that at the previous Zoning Board of Appeals hearing numerous i;ssues were brought up characLerized by Mr. Zajicek as Plan Commission i�ssues. He noted that it is up to the Plan Commission to define the f:ront yard .and that the petitioner proposes the creation of an interior lat and not a flag lot by virtue of the proposed subdivision. He noted that thz proposed subdivision would have a 20 foot minimum access pro- v:ision which satisfies the Subdivision Regulations. He further noted tizat the theory and intent of the Subdivision Ordinance is to allow i�terior lots, provided there is permanent access. Member Hodges noted that the width of the Southerly proposed lot and not the minimum access provision for the interior lot is the question before the Zoning Board of Appeals. - Mx. Zajicek explained that a flag lot access area is not counted for the m:inimum lot area and notes that the proposed Southerly lot, subtracting the ac�cess area, meets the lot requirements of the R-2 District. In answer to a question from Acting Chairman Hodges, Mr. Zajicek noted that the proposed lot 1 is an interior lot. Further questions from Acting Chairman Hodges concerning the lot area for lot 1 was answered by Mr. Zajcek with an explanation that the petitioner could seek a Plan Commission variance fr.om the 20 foot requirement for the access area. He further explained the d�screpency in the Zoning Ordinance provisions under the R-2 District for m�asuring lot width within the buildable area and the Zoning Ordinance definition of "lot width". Finally he noted that the loan objector that spoke at the September hearing would not be here but for a prior variation gi�anted by the Village in regards to the lot which that person now o�ms. In answer to a question by Actin� Chairman Hodges, Mr. Zajicek noted that tl-►at location of the proposed residence is only tentative based upon er�gineering recommendations and that no potential purchaser is presently , kr�own. Mz�. Zajicek answered Member Savino's question that the hardship in question i� that one family is forced to support two acres of property when the Zcning Ordinance requires only one acre area. Member McCormick questioned the potential development of the vacant area to the North and the nature of that development. Mr. Zajicek noted that he had no idea of how or when that property will be developed. Mr. Zajicek noted that he desired Plan Commission issues regarding the access area in question and other Plan Commission issues to be left to the Plan Commission and only desired an answer to the variation question. He noted that a total of 62 feet in variations was granted to the properties to the South and that his client is only asking for a 42 foot variation for similar sized property. No one else spoke in favor of or opposed to the application in question. In answer to a specific question from Acting Chairman Hodges, Mr. Zajicek noted that he would desire Member Crouch to vote, but that he desired to vote tonight as opposed to waiting another month for a transcript to be pregared and reviewed by Member Crouch and the other absent members. DENNIS J. TWAROG - LOT SIZE VARIATION � Mr. David Zajicek, attorney for the owner, described the property in question as ap�proximately 2.097 acres West of Oak Brook Drive and North of Oak Brook Road (3ist Street). He noted that the petitioner seeks a variation from the R-2 l��t width provisions to allow the subdivision of a lot into two (2) lots, one (1) lot which would have a frontage of 108 feet and rear lot line of 94 fe�t in width. He thereupon presented and explained six exhibits as f olloias: Exhib:it 4�1 - Preliminary Plat of Subdivisian of the property in question � Exhibit ��2 - Zoning Map of the Village of Oak Brook. Exhib:it ��3 - Aerial photograph of the property in question. . . E�ib:it ��4 - Site Plan thereof. Exhib:Ct ��5 - A group pictoral exhibit showing the various perspectives- of the propert . Exhib�it ��6 - A copy of the Plat of Rickert's Subdivision. � Mr: T�iarog then testified that he purchased the property in 1971 from �ir. and Mrs. Kossman. He furrher testified that the Rossman's wanted to sell all of tneir 6.5 acres to Ztaarog but he wanted to buy only one acre. He noted that they would not sell less than two acres which_is the present property �rhich is the subject of the present petition. The ne�t witness for the petitioner was Mr. Larry Fillippi, a land planner, who e�.-plained his analysis of the property as well as the characteristics of the prope7-ty. He noted that there is a buffer of pine trees along the South prop- erty 7_i::e of the property in question which pr�vides effective screening for that lot. He further noted that the site is unique due to the large un- build�b?e area to the kTest which enhances the open space concept. Although he not:ed that�.the lot size is important, this size is unique and that lot width is not important here since the proposed house on the proposed lot ��1 would be approximately 65 feet from the house to the South well in excess of the re�quired 18 foot side yards for each structure in question. Mr. Fillippi furthe:r noted that the site is slightly rolling and the proposed house site • is set: on the highest point in order to preserve the view on the lot and also to fux�ther preserve the trees on the site. He fur�ther offered his opinion that the variation if granted would not cause . any re.duction in value to the surrounding property and would have no adverse effect on the surrounding property. . Mr. Zajice� further noted that soil tests have been made and perculation tests � conducted on the site which showed that the soils are appropriate for the proposed construction as well as to construct a septic system for the property. He then offered into evidence the aforementioned Exhibits ��1 thru ��6 as well Exhibit 1�7, an engineering report, regarding the soils and Exhibit ��8, per- culation test relative to acceptability of the property for a septic system. TWAROG - LOT SIZE VARIATION (Continued) � He further described the proposed creation of a common access easement for the two properties in question and noted that there would be another easement for the mutual benefit of both properties over the West 8 feet of the property. He explained that the question of lot width as to the proposed lot ��1 is less important because of the immunities featured on the site. He suggested that as a condition of the variation if granted, it would be appropriate to require a more extensive rear yard set back than the Zoning Ordinance requirement of 60 feet, and would agree to such a condition. He noted that in his opinion _ the property as presently zoned is under developed in allowing only one house on a two plus acre site. Mr. Zajicek then offered into evidence Exhibits ��9 through �13, being letters from surrounding property owners stating no objection to the proposed varia- tion. He further explained that variations have previously been granted to the two lots to the South pursuant to Ordinance 5-125 which was offered into evidence as Exhibit ��14. " in response to a question by Member Hodges, Mr. Zajicek noted that the proposed lot ��1 would be less than one acre if Oak Brook Drive were dedicated as a public street. He e�lained that Oak Brook Drive is a private street and see,s this situation as comparable to the lot to the South. He further noted that he does not see the common drive as a problem. Member Hodges noted that he seesthe"undersized lot being taxed to the limit by the common access drive easement whereupon Mr. Zajicek noted that he sees the hardship justifying the variation as having the owner maintain the two acre lot where the Ordinance requires only one acre under the R-2 zoning. In response to a question by Member Muschler, Mr. Zajicek noted that the 94 foot rear lot line width is necessary in order to keep proposed lot �2 as one acre. In response to a question by Member McCormick, Mr. Zajicek noted that the two Iots to the South were granted their variation pursuant to Ordinance S-125 in 1967 and that apparentZy no plat of subdivision of these two resultant lots were ever recorded. rlember McCormick noted that the plat shows no proposed easements for the proposed lot ��2 and questioned the possibility of a dedica- tion of the street in question. Mr. Zajicek noted that he sees no possibility � for the driveway easement over to the proposed lot 462. Member PicCormick further noted that the situation involved presently does not even have a flag lot and that there is no front lot line for proposed lot �2 since it does not abut a street. Member Hodges noted that he does not see the private drive as a street and cited the Subdivision Ordinance in support of that pasition. He noted that an access area should be deducted from the lot area calculations. Mr. Zajicek noted that he sees the access by the private road appropriate � in the context of the variation. Chairman Baroni questioned the need for access to the West for lot �1. - Mr. Zajicek cited the Hollirob Acres Subdivision flag lot in comparison to the proposed lot ��1 and noted his proposal reflects better planning. He further noted that he sees the access road as a subdivision problem � . and not a variation issue. Mr. Zajicek noted his desire to further review the Subdivision Ordinance before further comment on the access drive question and suggested a continu- ance �of the hearing for the purposes af this review. . In answer to a question by Chairman Baroni, Mr. Zajicek noted the property to th�e North is vacant and that he sees no difference between the proposal in qu�estion and a flag lot from a planning perspective in that the end re�ult is the same. No on� else spoke in favor of the petition. David Resh has spoke in opposition to the petition and testified that he lives immed:iately South of the subject property. He noted that he does not see the a��cess driveway as part of Oak Brook Drive. He testified that only three houses are affected by the proposal and that his property is approximately 1.25 :3cres. In conclusion he used the proposed creation of lot ��l as awkward and nc�t ia the best interest of adjacent property owners. Mr. R�sh noted for the record that the Subdivision Ordinance was not passed until 19;1, subsequent to the variations noted earlier made to the lots to South.. �:r. Resc noted also that he feared increased traffic as a resul.t of this propased subdivision. in respo:.se to a question by Member Fullan, Mr. Resh noted that he bought�his • house approximately three years ago. In response to a qu�stion by Chairman Baroni, Chief Clark noted that a 10 foot drive access area is sufficient for fire truck purposes.
