Included with the passage of this Code was a section related to the

We feel that the benefit of this sprinkler ordinance will snake the Village
of Oak Brook a safer place to work and to educate a Paiute generation of this

. As per our telephone conversation regarding the recently
submitted specifications for the new gymnasium for "the Paul •
Butler School. I explained to you that the Architect, John A. -
Iacopi & Associates failed to submit sprinkler drawings with .
the plans. As you are aware the Village of Oak Brook adopted •
a total sprinkler ordinance for all buildings within the• Villago
excluding single residential hones. -
• Based on our conversation you indicated that you would contact
the architect and have him investigate the installation of a :
sprinkler system for the gymnasium at this time, also the rest
of the school would have a schedule worked out to be sprinklered
agreeable with all parties. • .
• I will be out oe town from March 15th thru March 20th, and would
appreciate a meeting set up with you and your architect the week • •
of March 22, 1981 . - If this can be arranged pleas call Lt. Robert
Nielsen with confirmation of this date and a time.

I forwarded to the Board of Education information concerning your request for
sprinkler systems for the District's two schools. Because of the District's r'
present financial position and the fact that a sprinkler system was not con i
sidsred prior to the bond referendua there is little likelihood that funds
will be available for this kind of expenditure within the next year. However,
if the Board of Education expresses interest it is possible that funds will be
set aside within the next year or two to initiate a sprinkler system in the
District's schools.

We are appreciative of your interest in our buildings and the safety of our
pupils. I will keep you apprised of any action taken by the Board of Education.

RECOMMENDATION: That the President and Village Board meet
with the Superintendent of Elementary
School District #53 and the Board of
Education to resolve the problem rega.ding
installation of a sprinkler system in the
new addition to the Butler School
Attached to this letter is a chronological sequence of events
regarding the proposed addition to the Butler School. As I
have mentioned to you, I am concerned as there are NO pro-
visions to include a sprinkler system in this addition.
This matter was originally• brought to the attention of the
Superintendent of District #53, Mr. Garinger, on October 28,
j 1980. This was prior to any contact on the part of .the Dis-
trict with our office. No reply was received. On approximately
March 9, 1981, Lt. Nielsen received drawings of the addition
from. Mr. Iacopi, the architect. On March 13, 1981, I discussed
the matter with Mr. Garinger, followed with a letter. As a
result of my letter, Lt. Nielsen and I met with Mr. Garinger on
March 26th. This meeting brought a reply dated March 31st.
As you can see, there is no intent to sprinkler either the
addition or any part of the school. It is my feeling that,
because of the Village ordinance, this matter warrants Board
action to seek compliance. With the new gym construction,
costs will be minimal as will be class disruption.
It concerns me that we can, through local ordinance, require
all buildings to be sprinklered, yet the one occupancy which
stands to lose the most in termn of lives, feels that they
are exempt. I will appreciate your assistance.

Dear Mr. Malloy:
The Village Board recently learned of the building permit application of your general
contractor, A. M. Goebelt Builders, Inc. , for the addition to the Butler School.
This building permit has not been issued due to the failure of the plans involved
to reflect the inclusion of an automatic sprinkler system as required under the
Village's Fire Prevention Code. The Village Board asked me to convey to you and the
remainder of the School Board our comments relative to this issue in order that you
an fully understand the basis for our sincere concern that life safety considerations
be observed.
The Village of Oak Brook has been a leader in adopting modern life safety standards to
• be applied to all buildings within our community. Long before the fire disasters
reported in New York and Las Vegas vividly and tragically demonstrated the need for
protection,.sprinklers have been a requirement in Oak Brook. We have uniformly ap-
plied the sprinkler requirements throughout the Village. All public buildings, both
old and new, have been protected. All churches and non-public schools have installed
sprinkler systems to assure safety for their occupants and users.
We are certain that District 53 Board of Education appreciates that the installation j
of the required sprinkler system into your addition will provide much greater pro-
tection of your substantial investment, as well as maximize the safety of the users
of that building, be they school children, other citizens or private users.
We are particularly disappointed that the School Board which is charged with •the ed-
ucation and safety of the children of the community would consider attempting to dis-
regard any of the laws of the community in which it is located, and particularly re-
quirements relative to fire safety systems.
The Village and School District 53 have consistently enjoyed a close relationship of
intergovernmental cooperation based upon the mutual desire to provide for the re-
spective needs of the citizens of the Village of Oak Brook. We would hope that the
Board of Education will reevaluate its position regarding the installation of an
automatic sprinkler system for its new addition, recognizing that the present in-
stallation of such a system and the School District's committment to construct such
a system can only enhance its reputation of leadership in meeting the needs of the
citizens of the Village.

inspected both schools.
On Dec. 3, 19810 Mr. WM. Clifford, National Fire Protection Co., Oak •
Brook, inspected both schools.
• Both Contractors were in general agreement. There are numerous var '
iab],es to be considered. Among them are:
I. Length of underground water main, from school. •
. • building to Village main in street. This. length
will be determined by the location of the in-bldg.;
equipment, i.e., check valve, O.S.& Y. valves, etc.
a. Any. related•. Village fees, i.e., tap-on.
• 3. Aesthetics of system. The most reasonable type
• of system will be exposed piping, with a sidewall
type sprinkler head. The most costly_ would be a
• hidden piping system, with deluxe heads (chrome'
recessed). The ideal will be probably a compromise

in between.
• 4. Would system be drawn by contractor, after bidding,
or would Dist. 53's architect drawn up working plans,

Of all. of these items, Item #3 poses the greatest variable in any

Our last meeting with your committee was November 24, 1981. We
have also provided the information you requested to enable the
District to establish a complete cost analysis for the installation
of sprinkler systems within the District schools. . As you know, the
Fire Department will work out a phasing progran over a period of
time as we have done in the past with other caries so as to not
create an economical burden on the School District. NowT that all
data is in the District's possession, and it has been reviewed, I
would personally like to again meet with you and representatives of
the District to review the status.
As you are well aware, we are both keenly interested in the fire
safety of the children of Oak Brook. We both know that the installa-
tion of this system will provide this, and at the same time afford
the District the property protection needed so vitally necessary. We
appreciate the cooperation that you and the Board have provided this
far, and I look to a culmination of this matter with all concerned.

The representatives of the School District indicated that the School Distrt is
currently invovied in litigation with the roofers of the Brook Forest School. That
issue must be resolved before the School Board can do anything related to sprinklers. I 1
The issue should be resolved within the next several months, estimated to be 3 to 4
months.
If the guarantee issue on the roof is resolved in favor of the School, there`will be
$160,000 of expense which the school will not be responsible for. However, if the
decision is against the School than that estimated coat will have to be financed and
paid for by the School District.

The School District is also experiencing a problem with deterioration of the galvanized li `
pipe at the Brook Forest School. It may have to replace that piping, and,` if again, (�
that is the cite, in conjunction with that the School will consider the placement of
sprinkler *Yeti)** me part-of that repiping.
The financing of the sprinkler systems for the two schools, which is estimated currently
based on quotations received from two companies to be $250,000 will require a referendum
in the coo amity to finance the improvements. This $250,000 does not include the master
control or the mater service from the watersatin to the building. It was determined that
both schools have master controls and that that expense,:would
probably not be required.
The School District asked=if the Village of Oak Brook would be willing to pay for the
neater line from the main water system to the building itself. As, was pointed out this
might conflict with the conditions under the revenue bond issue as it relates to the
bond holder and the water system. Trustee Tare indicated that that issue would have
to be reviewed in detail by the Village Board and no commitment could be made at this
time.

Dear Mr. Malloy: •
I am writing subsequent to our recent conversation regarding the
status of your fire sprinkler system survey for our two schools. As
I mentioned to you, we have not met on this subject for almost two
years. For this reason, we feel that it is appropriate that we sit
down and discuss the status.
Also as we discussed, in light of the proposed addition to the Brook
Forest School, now is the time to implement the sprinkler system
within this School. We would welcome the opportunity to meet the
District's proposed architect to further discuss this installation.
As you are aware, it is the desire of the Village Board to implement
this installation. Our Village now boasts a 75% sprinklered statistic,
with 100% of all assembly and educational type occupancies sprinklered
except the public schools. All concerned parties feel that sprinklering

of our two schools would be a worthwhile asset, and we look to you and
your Board for any assistance you may give us concerning this matter.

On April 21st, Lt. Nielsen called Dr. M. Bloch, District #53 Superinten- II
dent, to ascertain the progress of the proposed fire sprinkler system ii
to be installed as part of the Brook Forest addition. At that time Dr.
Bloch informed both Lt. Nielsen and then myself that the sprinkler system

had been removed from the project by the School Board for financial I
reaaone.
This matter is now exceeding six years, and apparently the School Board I'
is not intent on installing these vital systems. For your benefit, I am
attaching a chronological survey of our progress. In the 1981 period, it
did appear that progress would be forthcoming. As five years have passed, Ii
with only sporadic activity on the matter, the School Board has again II
voted against the matter. P

As you review the copies of the topical correspondence, you will note the II
Village's patience in this matter. During this period we have gained
compliance of our sprinkler ordinance in all Places of Assembly and other
schools. In addition, compliance agreements are in effect c within high
rise buildings.

March 31, 1981 - Superintendent's letter stating that District is not in
financial position to sprinkler. Stated that they had
interest to oet aside funds and possibly begin in "year
or two".

V. RE9UEST FOR ANNEXATION - OAK BROOK TOWERS
(Butterfield Road & Me rimers Road)
Request from Oak Brook Towers Condominium Association, dated August 11,
1986 for annexation of the complex consisting of 364 units, which includes
22 townhomes. The consensus of the Board was not to annex this property.
VI. ILLINOIS MUNICIPAL LEAGUE DELEGATE AND ALTERNATE

Village Manager Sohn Brechin was appointed to serve as delegate to represent
the Village at the Annual Illinois Municipal League meeting to be held at
the Conrad Hilton Hotel, Chicago, Illinois on September 19 22, 1986.

Discussion on the addition to the school and the District's position not to
provide sprinklers in lieu of the proposed heat detection system. Suggestion
was made that the Village offer the sum of $12,000 to the school district ;I
to be used toward the cost of the fire line extension of the water main
from the street to the building if the Board of Education of District #33
were to express their willingness to contract for the work, but were deficient
in funds in the amount of $12,000. Staff was directed to inquire as to the
status of the sprinkler system for the school and ask them to communicate
to the Village any of their needs in this regard.
